01 Overview

This Return Policy applies to used agricultural and construction machinery purchased directly from CLASSTRUCKS POLAND SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ ("ClassTrucks Poland", "we", "us"), registered in the Polish National Court Register (KRS) under number 0000623355, with its registered office at Mszczonowska 35, 96-200 Rawa Mazowiecka, Poland.

We sell our own inventory of second-hand machines. Because every unit is used, individually documented and often exported internationally, returns work differently than for new consumer goods. This policy explains when a machine can be returned, how to start the process, and how refunds are handled. It should be read together with ourTerms of Service.

02 Inspection Before Purchase

Our strong recommendation — and the foundation of this policy — is that you inspect any machine before payment and dispatch. We support this in three ways:

  • On-site inspection: visit the machine at its stated location and test it yourself or with your own technician.
  • Live video inspection: a member of our team walks around and operates the machine on a live video call, following your instructions.
  • Independent inspection: commission a third-party inspector of your choice; we provide full access. See our Inspection Services page.

A machine accepted after inspection (in person, by video, or through an appointed inspector) is sold on an "as inspected" basis. Wear, defects and cosmetic issues that were visible or disclosed at inspection do not qualify as grounds for return.

03 Return Eligibility

A machine may be returned where, at the time of delivery, it:

  • materially differs from the written description, specifications or photographs in the listing and sales documents (for example: different model, year, engine hours, serial number, or missing documented equipment);
  • has a substantial hidden defect that existed before delivery, was not disclosed, and was not reasonably discoverable at the inspection stage;
  • was damaged in transit while transport was arranged by us (documented on the delivery note or CMR at the time of receipt); or
  • is not the machine identified in the sales contract (wrong unit dispatched).

Eligibility is assessed against the machine's documented condition at dispatch — every unit leaves our yard with a photo record, serial number confirmation and condition report.

04 Return Window

  • Visible discrepancies and transport damage: must be noted on the delivery documents at receipt and reported to us within 3 business days of delivery.
  • Hidden defects: must be reported within 14 days of delivery, and in any event promptly after discovery. Continuing to put the machine into commercial service after discovering an alleged defect may affect eligibility.
  • Wrong machine dispatched: report as soon as identified; no time limit applies to our own dispatch errors.

Reports received after these windows will still be reviewed in good faith, but return rights may be limited to statutory warranty claims (see section 10).

05 How to Request a Return

  1. Contact us in writing at[email protected]or via WhatsApp at +48 22 219 51 57, quoting your invoice number and the machine's stock or serial number.
  2. Describe the issue and attach evidence: photos, videos, engine hour readouts, error codes, delivery notes and — for transit damage — the annotated CMR/consignment note.
  3. Do not repair, modify or dismantle the machine before we have assessed the claim; unauthorised intervention can void return eligibility.
  4. Assessment: we respond within 3 business days. We may ask for additional evidence, arrange a remote diagnosis, or send / appoint an inspector to examine the machine where it stands.
  5. Decision: if the claim is accepted, we will offer — depending on the situation — repair at our cost, a price reduction agreed with you, replacement with an equivalent unit where available, or return of the machine and a refund.

06 Non-Returnable Situations

A return will not be accepted where the claim concerns:

  • normal wear and tear consistent with the machine's age, engine hours and disclosed condition;
  • defects, damage or cosmetic issues that were disclosed in the listing, condition report or during inspection;
  • issues arising after delivery from operation, negligence, lack of scheduled maintenance, use of improper fluids or attachments, overloading, or operator error;
  • damage occurring during transport arranged by you or your own carrier;
  • machines altered, repainted, repaired or dismantled after delivery without our written agreement;
  • change of mind, changed business circumstances, or the machine proving unsuitable for a purpose we were not informed of in writing before sale; or
  • consumables and wear parts (tyres, tracks, filters, batteries, cutting edges, teeth and similar).

07 Condition of Returned Machines

An accepted return must come back to us:

  • in the same condition as delivered, allowing only for the specific defect complained of;
  • with no more than a reasonable number of additional engine hours accrued during diagnosis;
  • complete with all keys, manuals, documents, attachments and accessories that were supplied; and
  • free of any liens, registrations or third-party claims created after delivery.

We verify serial numbers and condition on arrival against the dispatch record. Missing items or undisclosed additional damage may be deducted from the refund at documented replacement or repair cost.

08 Return Transport & Costs

  • Where the return is our responsibility (misdescription, hidden defect, wrong unit, transit damage under our transport): we organise and pay for return transport, or reimburse your documented, pre-agreed transport costs.
  • Where a goodwill return is agreed in other circumstances: transport, export/import formalities, customs charges and insurance are borne by the buyer unless agreed otherwise in writing.
  • For exported machines, both parties will cooperate on the customs paperwork needed for re-import; refund timelines run from the machine's arrival and verification at our yard.

09 Refunds

  • Refunds are paid by bank transfer to the same account (and account holder) from which the purchase was paid.
  • Approved refunds are issued within 14 days of the returned machine passing arrival verification at our yard — or, where no physical return is required, within 14 days of the written settlement agreement.
  • Refunds are made in the currency of the original invoice. Bank charges and exchange-rate differences imposed by intermediary banks are outside our control.
  • Where a price reduction is agreed instead of a full return, the agreed amount is refunded on the same timeline without the machine travelling back.

10 Defects & Warranty Claims

Used machines are sold with their condition, age and hours reflected in the price. Unless expressly stated in the sales contract, machines are not sold with a commercial warranty. Where a machine benefits from a remaining manufacturer's warranty or a separately purchased warranty package, this is stated on the invoice and claims follow that warranty's terms.

Independent of any commercial warranty, statutory liability for defects under the Polish Civil Code applies to the extent it cannot be contractually limited. For business-to-business sales, the parties' rights and any agreed limitations are set out in the sales contract and our Terms of Service.

11 Statutory Rights

Our services are directed at business users. If you nonetheless purchase as a consumer within the meaning of applicable law, nothing in this policy limits rights that cannot lawfully be excluded — including, where applicable, EU consumer rules on the conformity of goods. Note that the standard 14-day distance-selling withdrawal right applies only to consumer contracts concluded at a distance and does not apply to business purchases.
